Drawings
All specifications, drawings and particulars submitted by the supplier
are approximate only and the descriptions and illustrations contained
in any product supporting literature are intended to present a
general idea
of the goods and none of these shall form part of the contract. All
drawings prepared by the supplier under the contract shall remain
the property of
the supplier and the copyright is reserved accordingly. No copes
or extracts shall be taken without the suppliers prior written consent.
Delivery and Completion
Estimated times for delivery and completion shall run from the
date of receipt of an official written order and receipt of all
necessary
information
to enable the work to be carried out. All such items will be treated
as estimates only and shall not involve any contractual obligation.
Although
the supplier will use his best endeavours to despatch or complete
by the dates stated the supplier will be under no liability whatsoever
for failure
to do so.
Guarantee
The supplier warrants the materials and workmanship of the goods
supplied and undertakes to replace or repair any items supplied
which become
defective through faulty design, workmanship or materials not
due to ordinary wear
and tear or improper use within 12 months of their despatch from
the supplier. This shall be the sole liability of the supplier
(save in
respect of death
or personal injury caused by the negligence of the supplier)
whether in contract or tort and any other warranties including fitness
for purpose
or conditions implied by law are hereby expressly excluded. This
guarantee shall only apply if proper maintenance is carried out
where necessary by the supplier or a competent person approved by him.
Liabilities
The supplier shall not be liable by way of indemnity, breach
of contract or statutory duty of tort (including negligence)
for any
loss of
profit, loss of use, loss of contracts or for any financial
or economic loss
or for any indirect or consequential damage.
Applicable Law
This contract shall in all respects be subject to and construed
in accordance with English law.
New Lifts installed after 30th June 1999 must comply to the
Lift Regulations 831 (1997) and LCL shall at the quotation
stage advise
clients as to
the suitability of the components supplied for the application.
Clients are asked to contact LCL if components are NOT
required for use as replacement parts, but instead are
intended for
use in new
lifts when
relevant Lift Regulation documentation will be required.
WARNING
The installation of replacement parts or components in lift and escalator equipment
should be performed by a trained Lift Engineer who is familiar with the operation
and control of the system which is being repaired. Improper installation may
endanger the installer, the public, and the equipment. |
